Social Media and Its Many Workplace Complications
Presented by Tom Whitworth, Associate, Ogletree Deakins

Social media can be both friend and foe to employers. Social media presents unique opportunities for employers to enhance the hiring process, to access data, and to provide information to employees. More recently, however, the use of social media has become an important issue when dealing with employment and post-employment issues. Social media may give an employer information management would rather not have, such as notification of an employee’s disability or other protected status. Moreover, issues have arisen relating to disputed ownership of social media accounts, customer information, and trade secrets, as well as the ways social media impacts confidentiality, nonsolicitation, and noncompete agreements. This presentation will examine each of these issues and provide best practices and practices to avoid.

During this session, participants will:

  1. Learn the correct uses of social media in the workplace, including recruiting and post-termination usage;
  2. Learn to avoid the common pitfalls and mistakes related to the use of social media in the workplace; and
  3. Learn the strategies necessary to design and implement an effective social media policy that protects the employer without violating the law.

Schedule: Doors open at 7:15 am for registration and networking and buffet breakfast. The presentation starts promptly at 8 am.

Biography: Tom Whitworth is an Associate in Ogletree Deakins’ Nashville office, where he represents and counsels employers on legal issues and disputes that arise in the workplace.

Tom’s practice includes litigating on behalf of employers in federal and state courts and before arbitration agencies against claims of discrimination, harassment, retaliation, and wage and hour violations. Tom also assists employers in navigating restrictive covenant issues and conducts investigations into sensitive workplace issues.

Tom began his career as a judicial clerk to the Honorable J. Daniel Breen in the United States District Court for the Western District of Tennessee. Prior to joining Ogletree Deakins, Tom practiced with a Nashville-based law firm, where he litigated insurance coverage and employment disputes.
