EEOC Update

At the end of each fiscal year, the EEOC releases statistical data about the charges it received for that year, the action taken with regard to those charges, and the enforcement action or litigation the agency ultimately pursued. Employers can use this data in conjunction with the EEOC’s Enforcement Guidance to collect important information about relevant trends and how the federal agency is trying to further its agenda. The EEOC’s focus is set forth in its Strategic Enforcement Plan for the 2018-2022 fiscal years. The 2017 report reveals that despite the decrease in overall charge numbers, there is a steady stream of retaliation and harassment allegations. 

In addition to the EEOC’s Select Task Force on the Study of Harassment in the Workplace, launched in 2015. The recent #MeToo and #TimesUp movements have shined a light on the prevalence of sexual harassment in the workplace, particularly those situations involving vulnerable women in low-wage industries. The 2018-2022 FY Plan lists the Commission’s strategic objective and outcome goals, which include combating and preventing employment discrimination through the strategic application of the EEOC’s law enforcement authorities, preventing employment discrimination and promoting inclusive workplaces through education and outreach and organizational excellence. 

This session will focus on the most pressing EEOC-related issues that employers are currently facing and strategies for avoiding such liability exposure.

The three learning objectives:

  1. Learn about the EEOC current strategic enforcement plan and its related initiatives.
  2. Explore why so many employers are being sued for violations of the ADAAA and harassment, and strategies for how to avoid such liability exposure.
  3. Explore why race and sex discrimination, as well as retaliation, are such frequently litigated issues, and strategies for how to avoid such liability exposure.

Schedule: Doors open at 11:00 am for registration and networking. Buffet lunch begins at 11:20 am, and the presentation starts promptly at 12 noon.

Biography: Brent A. Morris is a Senior Associate of the Nashville, Tennessee office of the firm, which he joined in 2016. His law practice has a focus in employment and housing discrimination matters in both State and Federal Courts. Brent also has significant experience in workers compensation, general liability matters and coverage issues. He received his Bachelor of Arts in English Literature from the University of Memphis and his law degree, cum laude, from the Cecil C. Humphries School of Law at the University of Memphis. Brent was a member of law review and a recipient of the Herff Scholarship. After practicing for several years in Knoxville, Brent took a position with Chubb Insurance in Connecticut where he was a member of the litigation management unit and an employment claims examiner.
